The HILS Companies make all reasonable efforts to ensure the accuracy and reliability of the information published on the Website and will endeavor to correct any errors or omissions as promptly as possible. However, the HILS Companies do not assume responsibility for any inaccuracies, errors or omissions in the information provided.<\/p>\n

Users expressly agree that the HILS Companies shall not be liable for any direct, indirect, minor, special, consequential or incidental damages, including but not limited to loss of profit, loss of commercial opportunity or other intangible losses, resulting from the use of the information available on this Website or from any other aspect related to the Website.<\/p>\n

Article 3. Complaint Handling Procedure<\/h3>\n

3.1 Any dissatisfaction or issue related to accessing and using our Website must be communicated directly to us, either by telephone at the number displayed on the Website or by email at marketing@hils.ro.<\/p>\n

3.2 Your complaint\/issue will be registered, and you will receive a written response at the email address provided when submitting the complaint, within a maximum of 14 business days.<\/p>\n

3.3 Users agree not to make such complaints public (including on social media, in the media, in private discussions or in any other manner), subject to liability for any damages caused to the reputation of the HILS Companies as a result of such actions.<\/p>\n

Article 4. Governing Law and Jurisdiction<\/h3>\n

4.1 These Terms of Use shall be governed by and construed in accordance with the laws of Romania. Any disputes or claims arising between the parties in connection with these Terms shall first be resolved amicably. If an amicable resolution is not possible, such disputes shall be submitted to the competent courts of Bucharest.<\/p>\n

Article 5. Governing Law. Severability. Force Majeure and Fortuitous Event<\/h3>\n

5.1 If any provision of these Terms of Use is declared by a competent court to be invalid, illegal or unenforceable for any reason, such provision (term\/condition) shall be removed, and the remaining provisions (terms and conditions) shall remain in full force and effect, continuing to be binding and enforceable. In the event of such nullity, the invalidated clauses, terms and\/or conditions shall be replaced with appropriate ones within 10 (ten) business days from the date on which the court decision declaring the nullity produces legal effects.<\/p>\n

5.2 The HILS Companies shall not be liable to the user for the non-performance of any obligation in cases of force majeure or fortuitous event and, in general, in the event of circumstances beyond their control, including the operation and connection of other national or international networks and their related activities and actions.<\/p>\n

5.3 Force majeure or fortuitous events may include, by way of example but not limitation: legal measures in situations of strikes, including those occurring within third-party companies; official measures taken by authorities; failures of communication networks and portals of other providers; disruptions affecting network operators and other malfunctions, including where such events occur at the level of subcontractors, sub-suppliers and their subcontractors; war (declared or undeclared), armed conflict, revolution, insurrection, military or terrorist actions or threats, sabotage, civil unrest, strikes or other labor disputes; laws, regulations, decisions or directives; natural disasters; earthquakes; fires; explosions; solar or meteorological disturbances; public emergencies; pandemics; measures adopted following the declaration of a state of emergency or alert by the authorities in Romania or other states; or any other event beyond the reasonable control of the company.<\/p>\n

5.4 If, within 15 (fifteen) days from the occurrence of a force majeure or fortuitous event, such event does not cease, either party shall have the right to notify the other party of the automatic termination of the contract, without either party being entitled to claim damages from the other.<\/p>\n

Article 6. Amendments and Updates to the Terms and Conditions<\/h3>\n

6.1 The HILS Companies reserve the right to periodically amend the Terms of Use as well as any other specific terms and conditions displayed on the Website. The amendments shall enter into force at the time the updated terms are published on the Website. Continued access to and use of the Website constitutes the user\u2019s agreement to comply with the amended terms.<\/p>\n
